One of the Texas originals, Whataburger, is currently facing a lawsuit from Nearby Systems LLC which accuses the eatery of taking certain items for their app. Here's what is known at the time of writing.

Nearby Systems LLC Files Suit For Claimed Theft Of Certain Items

As reported by Chron, Nearby Systems LLC issued the legal action on November 20th, 2024. This is one of multiple lawsuits the company has issued. Nearby Systems LLC has also brought forth lawsuits against CVS, Deli Management, Rent-A-Center and Truist Financial, which the latter happening in the previous month of October.

Nearby Systems LLC's suit deals with certain parts of Whataburger's app. The app in question was reportedly very helpful in the aftermath of Hurricane Beryl. With the assistance of geomap, individuals could find out which Whataburgers were open and other Whataburgers that were unavailable.

Per Chron, Nearby Systems LLC alleges in their suit that the eatery violated three specific patents that are connected with "mashing mapping content." Whataburger isn't the only company Nearby Systems LLC is seeking damages from. JCPenney was also served a lawsuit, and Chron reports both the JCPenney and Whataburger legal actions deal with the same three patent that are claimed to be infringed upon.

At the time of writing, Chron reached out for a comment from Whataburger, but they haven't responded. As this is a developing story, we will have more information when it becomes available.
