Mark Abaire, 52, of East Naples, Fla., is facing five years in prison over a $1 fountain drink.

He asked employees at a McDonal's restaurant for a cup for water. He filled the cup with coca cola instead of water.

The police were called and the office who responded found Mark Abaire to be drunk. He was charged with disorderly intoxication, trespass and theft and is being held on $6,500 bond.

Mike Adams, who owns the McDonald's where it all took place said, "I take these matters seriously. As a local business owner, I have a responsibility to take appropriate steps to protect my business and keep my customers and employees safe," Adams said. "We are fully cooperating with the authorities on this matter. I have an obligation to the public to adhere closely to local and state laws and rely on the counsel of local law enforcement regarding these types of issues. Beyond that, it would be inappropriate to further comment."

Adams did go on to say, "Further inquiries should be directed to the Collier County Sherriff's Office."

In my personal opinion, the guy is most likley just the town drunk. And he did intend to fill the cup with water. Then, when he went to the drink machine, the coke looked better than the water, so he decided that just one cup of coca cola wouldn't put McDonald's out of business. He has seen the signs that say "over a billion sold" just like you and I have. He could have gone for the 'Spit Tea'.

Sure, he stole a cup of coca cola, but to me, five years in prison seems way too harsh for such a petty crime. What do you think? Take a second and give your answer in the poll below.
